The ECJ judgment in the William Hill case has been followed up, at EU level, with a formal review of the Database Directive (a case of ‘legislate in haste: repent at leisure’?) and the important case of Attheraces where the emphasis has shifted to competition law and excessive pricing as abuse of dominance. This session will address the developments in this area of law in the two years since William Hill in the ECJ and suggest practical steps to protect and exploit data as an asset.
