Redundancies are high on the agendas of most organisations in the current downturn. The development of employment law in the UK since the last recession has meant that HR restructuring is now a complex and frequently fraught exercise: employers can fall down by ‘pre-determining’ dismissals such that the redundancy consultation is a sham. Getting it wrong can be expensive – the maximum compensation for an unfair redundancy is ordinarily in the region of £70,000 for each employee.
