What to do when things go wrong: protecting your business against the misuse of confidential information

The potential for staff to misuse confidential information, company data and computer systems is a cloud that hangs over nearly every business. With the proliferation of new technology and increasing awareness of the capabilities of computer systems, this is a growing threat to employers - particularly those dealing with disgruntled employees or those intent on joining a competitor.

Time is of the essence when things go wrong but few employers have a plan of action. Even fewer employers are aware of the means available to them to investigate concerns, identify what has occurred, recover confidential information and data, and to otherwise ensure that the business is properly protected.

At this forum, Kemp Little in conjunction with Kroll Ontrack, the technology services division of Kroll, looked at the legal and practical steps which should be taken if concerns arise. This includes looking at what an investigation can reveal and how evidence (including computer systems, laptops and mobiles) should be preserved  particularly when steps have been taken to try and delete or otherwise destroy evidence.
