European Commission Market Tests Visa's Latest Commitments

On 13 June 2013 the European Commission announced its consultation on the commitments offered by VISA Europe to address the Commission’s concerns identified in its July 2012 supplementary statement of objections (“SSO”).

The European Commission’s competition concerns

The SSO identified concerns in relation to consumer credit card interchange fees for international and cross-border transactions in the EEA as well as domestic transactions in Belgium, Hungary, Iceland, Ireland, Italy, Latvia, Luxembourg, Malta, the Netherlands and Sweden. The Commission found that these MIFs are contrary to Article 101 of the Treaty on the Functioning of the European Union.

In addition, the SSO identified competition concerns with VISA Europe’s rules on ‘cross-border acquiring’ in the Visa System which oblige banks to apply the interchange fees of the country where the merchant is located even if the fees in the country of the acquirer are lower. MIF levels diverge widely between Member States and as a consequence, such rules limit cross-border competition and reinforce barriers to completion of the single payments market.

Visa Europe’s commitments

In its commitments, Visa Europe has offered to:

  • cap interbank fees for cross-border and domestic transactions to 0.30% of the value of the transaction. This would reduce the fees by 40-60% of their current amount. The cap will apply to cross-border transactions within the EEA and to domestic transactions in each EEA country where Visa Europe sets the MIFs directly or in the above-mentioned countries where cross-border rates apply by default.
  • reform its cross-border acquiring system so that banks will be able to apply either the domestic rate or a reduced cross-border interchange fee for both debit and credit transactions when they compete for clients’ cross-border. This is expected to lead to considerably lower rates for merchants in the EEA, ultimately benefiting final consumers.

In relation to international fees, Visa Europe’s commitments apply to cross-border card payments from the whole of Visa Europe’s territory which stretches beyond the EEA.

Other fees charged when non-EEA-residents use VISA cards in the EEA are still being investigated by the Commission.
