5 Things you need to know about the Insurance Distribution Directive

On 1 October 2018 the requirements of the Insurance Distribution Directive 2016/97/EU (“IDD”) began to apply to firms. As sales of insurance products have been regulated for some time, the IDD has slightly passed under the radar compared with some more major regulatory developments recently like Solvency II, MiFID II and PSD2. Here are five things you need to know about the new regime for the distribution of insurance products.

1. Scope

The scope of the rules governing the sales of insurance products has been widened from the regime established under the Insurance Mediation Directive 2002/92/EC (“IMD”), which has been repealed and replaced by the IDD). The rules now apply to all sellers of insurance products (known as insurance distributors, which replaces the slightly confusing concept of an “insurance intermediary” under the IMD), including insurers and reinsurers that sell directly to customers, as well as insurance and reinsurance intermediaries and ancillary insurance intermediaries.

2. Insurance

As with the IMD regime insurance and reinsurance distributors are required to hold professional indemnity insurance (“PII”). Under the IDD the PII requirement has risen from €1,000,000 to €1,250,000 per claim per year, and from €1,500,000 to €1,850,000 per year in aggregate for all claims. To avoid confusion with exchange rates, the euro will continue to be the relevant currency for calculating the PII required. 

3. Continuing Professional Development

The IDD requires improved professional standards in the distribution of insurance products. As part of this, firms engaging in insurance distribution activity will be required to provide staff with 15 hours of continuing professional development per year, focussing on policy terms, applicable law and complaints procedures. This contrasts with the previous IMD regime which did not specify precisely what training was required.

4. The IPID​

The IDD has introduced greater disclosure requirements in relation to insurance products. In addition to standard information disclosure and status disclosure as required already, firms now must provide an ‘insurance product information document’ (“IPID”) to certain customers for sales general insurance products. This is similar to the Key Insurance Document, which is already required when selling long-term insurance investment products.

5. Acting in the customer’s best interest

There is a new obligation for insurance distributors to always act honestly, fairly and professionally in accordance with the best interests of their customers. This obligation has prompted the FCA to create a new glossary definition of ‘customer’s best interest’. This is not entirely new in the UK, with the requirement to act in a customer’s best interest having existed for many years in conduct of business regulations. However, it is indicative of the ongoing struggle between regulators and the financial services industry around concepts of fiduciary obligations and relations of trust between product providers and distributors and end customers.
