Your organisation has a lot of data. Be honest, hand on heart, how well do you understand the rights that relate to that data?
Data is flooding into the business through all sorts of conduits, for all sorts of purposes. There’s data you are officially licensed to use; data you’ve got permission to use; open source data; data from social media; data scraped from somewhere on the internet. Once inside the organisation, it gets hard to track contractual obligations. There’s a real danger if you don’t really know what you’ve got and what you can legally do with it that you can trip up badly, especially when it comes to using that data for commercial gain. You could easily end up breaching third party rights and embroiled in a dispute.
The first step is watertight data management. It’s not a legal thing but a management discipline (and we have a data management tool you can use). Most disputes arise from a failure of process. When data is managed properly, then you can see if the licence lets you use/manipulate it. Or that there is no licence in place.
